Maryland Employers Have a One-Time Opportunity to Delay FAMLI Contributions Until 2028

Many Maryland business owners are still unaware of the upcoming Family and Medical Leave Insurance (FAMLI) program and an important opportunity available before the state program begins.
Under Maryland's current implementation schedule, employers and employees participating in the state plan will begin making contributions in 2027, even though benefits will not become available until January 2028.
What many employers don't realize is that there is a one-time opportunity to delay those contributions.
A Declaration of Intent Can Make the Difference
Between September 1 and November 15, 2026, employers may submit a Declaration of Intent (DOI) to pursue a Qualified Private Plan.
With an approved DOI and a Qualified Private Plan, employers and employees would not be required to make contributions to the Maryland State Plan during 2027. Instead, contributions would begin when the Qualified Private Plan takes effect in 2028.
Depending on a company's size and payroll, that could allow approximately $4,500 or more to remain with the business during 2027 rather than being paid into the state plan.
